Willie Lewis Sherman brought this suit against his former employer, Burke Contracting, Inc., and its president and principal owner, William Burke, (collectively Burke) seeking recovery for two acts of racial discrimination. Sherman’s complaint contained five counts alleging violations of federal civil rights statutes and Georgia tort law.1 All of the counts were based on two factual episodes.
