GILLIAM, District Judge.

Plaintiff, a minor resident of the State <of Wisconsin serving in the United 'States Navy and stationed at Portsmouth, Virginia, rode as a passenger in an automobile owned and operated by the defendant, a Virginia resident. By reason of defendant's negligence, a collision occurred in North Carolina and plaintiff was injured. Plaintiff agreed with the adjuster for defendant’s insurance company to settle the claim.
