MEMORANDUM OPINION AND ORDER

SANDERS, Senior District Judge.

Before the Court are Plaintiffs Motion to Remand, filed April 27, 2005; Plaintiffs Motion for Leave to File First Amended Complaint, 1 filed April 27, 2005; and Defendant’s Responses, filed May 16, 2005. For the following reasons, Plaintiffs Motion to Remand is GRANTED and Plaintiffs Motion for Leave to Amend is DENIED as MOOT.
