On March 20, 1936, the Indian River Orange Lands, Inc., a corporation, filed in the Circuit Court of St. Lucie County, Florida, against B. A. Brown a declaration on a promissory note substantially as follows:

“Indian River Orange Lands, Inc., a corporation, by its undersigned attorney, sues B. A. Brown, defendant, for that, the said defendant, B. A.
