At the September term, 1914, of the Knox Circuit Court Thomas Brogan was tried and convicted of the crime of wilful murder. His punishment was fixed at confinement in the penitentiary during life. On a subsequent day of the term he filed his motion and grounds for a new trial, which the court, after due consideration, overruled on the last day of the term; and thereupon *749the defendant was brought into court and sentenced.
