[1] Appellee’s first position in his brief filed in this court questions the jurisdiction of this court to hear and determine this cause on its merits, for the reason that the judgment in the trial court was rendered in favor of appellee against Paul Bauer, individually, for $3,812.50 and for a lien on a $2,000 note and for the foreclosure of same against defendants Paul Bauer, Wm. Barbee, and J. W. Hazzard, receiver, and against Mrs. N. W. Johnson and the First National Bank of Houston, Tex., while the appeal bond of appellants, Hazzard and Bar-bee, the only defendants appealing, was not…
