OPINION

{¶ 1} Defendant-appellant, Todd David Presley, appeals from a judgment of the Franklin County Court of Common Pleas finding him guilty of three counts of rape in violation of R.C. 2907.02.

{¶ 2} On July 23, 2001, defendant was indicted on 18 counts of rape in violation of R.C. 2907.02. Counts one through three alleged sexual conduct with the victim from October 1, 1994, to August 31, 1995.
