[dissenting opinion filed April 10 (286 Pac. 673) ]: In expressing my views in this case I shall lay -to one side, as much as that can be done, such expressions in the opinion as “syllogistic *263seven-league boots,” “the gingham dog and the calico cat,” references to the animal that “brays instead of neighs,” and “the hairy hand ... of Esau,” for I have a firm conviction that such acrobatic intellectual feats have no place in a judicial opinion.
