This case comes up on a rule taken by the appellants on the dative testamentary executor of the last will and testament of Alexander Milne, deceased, to show cause why he should not pay over to them the amount of money now in his hands belonging to the succession, or a sufficient sum to pay and satisfy the unliquidated balance of the judgment rendered by this court in March, 1841, in favor of the appellants, to wit, the sum of thirty-eight thousand dollars or thereabout.
