In February 2003, Tonya Laura Steele entered a nonnegotiated guilty plea to aggravated assault and possession of a firearm during the commission of a crime. The trial court sentenced her to a period of confinement and ordered her to pay victim restitution in the amount of $22,325. Steele subsequently moved to modify her sentence, requesting that she be treated as a first offender pursuant to OCGA § 42-8-60 et seq. She also sought a restitution hearing.
