The plaintiff in error was indicted upon a charge of murder in the second degree growing out of the collision of an automobile driven by him with another vehicle in which the deceased, Miss Kay Pierce, age 20, lost her life.

*60A jury found the defendant guilty of involuntary manslaughter and fixed Iris punishment at not less than one nor more than three years in the State Penitentiary. The judge sentenced him in accordance with the verdict. When his motion for a new trial was overruled he prayed for and was granted an appeal to this Court.
