Defendant was convicted after a trial without a jury on December 7, 1956 in the Justice’s Court of the Town of Jerusalem of violating subdivision 1 of section 56 of the Vehicle and Traffic Law. The court imposed a fine of $25 which was paid. From this judgment of conviction the defendant has taken this appeal in which he alleges five errors. Foremost and first of these is that of a defective information. The defendant at the opening of the trial made a motion for the dismissal of the information as being defective.
