OPINION AND ORDER REGARDING DEFENDANT’S MOTION TO DISMISS

I. INTRODUCTION

Plaintiff Trina Garza commenced this suit in Wayne County Circuit Court, State of Michigan, on or around April 23, 2003, asserting claims on her own behalf and on behalf of her daughter, Brittany Weir, arising from the alleged molestation of Brittany by a fellow passenger aboard an August 4, 2001 flight operated by Defendant Northwest Airlines, Inc. Defendant removed the ease to this Court on May 19, 2003, citing diversity of citizenship among the parties.
