I. INTRODUCTION

The plaintiff, Capitol Indemnity, requests a declaratory judgment that it had no obligations, pursuant to the terms and conditions of the general Lability insurance policy issued to Evolution Incorporated to provide coverage for personal losses sustained by Evolution or to defend or indemnify Evolution against claims made by other individuals or entities as a result of the fire at Tropics Nightclub.
