The plaintiff recovered a judgment against the defendant, the American Union Life Insurance-Company, in April, 1902. Execution thereon was issued and. *33returned wholly unsatisfied. Some months thereafter the plaintiff brought this action “ on behalf of himself and all other creditors of the American Union Life Insurance Company, who may come in and be made parties hereto, and also on behalf of such stockholders of said corporation as may come in and be made parties hereto,” against the Security Trust and Life Insurance Company, the American Union Life Insurance Company, Francis Hendricks, as…
