Jacob Eisher was brought before this court upon a writ of habeas corpus, for the purpose of inquiring into the legality of his imprisdnment. He is detained in prison under a judgment rendered by a justice of the peace, in a criminal action against him for selling malt, spirituous, and vinous liquors without first having obtained a license therefor. Under the statute relative to the “License and sale of liquors,” a justice of the peace has jurisdiction in all cases where the penalty or damages does not exceed one hundred dollars; and in this case the prisoner was tried before a justice’s court…
