AYRES, Judge.

Plaintiffs have appealed from a judgment sustaining exceptions of no cause of action filed and urged on behalf of the defendants, W. S. Mason and Mrs. Katherine Price Mason.

Plaintiffs instituted this action primarily to recover legacies under a particular title allegedly made to them by the last will and testament of Claude Elmo Jones. These legacies allegedly consist of cash, with an additional bequest of an annuity payable monthly to plaintiff George W. Jones.
