In this proceeding instituted on November 27, 1963 against the Louisiana Public Service Commission (hereinafter referred to as the Commission), plaintiff, New Orleans and Northeastern Railroad Company (hereinafter referred to as the Railroad), prayed that there be judgment in its favor decreeing that the Commission is without jurisdiction ratione materiae to hear or determine the cause entitled Board of Levee Commissioners of the Orleans Levee District v.
