The appellant was charged with larceny in Shawnee county; and, having been convicted, appeals to this court, alleging, as errors in this trial, the admission of improper testimony, the giving and refusing instructions, and the overruling of a motion for a new trial, because the verdict was not sustained foy the evidence. The information was for stealing a set of double harness from John W. Surfis, of the value of fifty dollars.
