The plaintiff in this action seeks to recover $132,000 in damages for the alleged breach of a contract terminated by the government for its convenience. The government has *343moved for summary judgment on (1) its affirmative defense that an unlawful arrangement between the plaintiff and one of the government’s agents rendered the contract unenforceable against the government, and (2) its two counterclaims for the amounts the government previously paid under this and other contracts tainted by the same illegal arrangement.1 We heard oral argument, in which the plaintiff did not participate.
