Pending are Defendants’ Motion for Summary Judgment (Document No. 24) and' Plaintiffs Replacement Motion for Summary Judgment (Document No. 28). After carefully considering the motions, responses, replies, and applicable law, the Court concludes for the following reasons that Plaintiffs motion should be granted.
