CHAMBERLIN, JUSTICE, FOR THE COURT:
¶1. Timothy Hinton died from injuries sustained in a fall from a tree stand. Timothy's parents, Marsha and Thomas Hinton (the "Hintons"), brought a wrongful-death suit against the manufacturer of the tree stand, C & S Global Imports, Inc. ("C & S"), and against Pekin Insurance Company ("Pekin").
¶2. After filing their third amended complaint, the Hintons filed a motion for partial summary judgment against Pekin. The Hintons claimed that Pekin waived its defenses to coverage or should be estopped from asserting any coverage defenses. Among other arguments, the…
