It will be seen from an inspection of the record in this • case, that the only question to be considered is, whether or not an appeal entered by a plaintiff to a jury in a justice’s • court from a judgment of dismissal of the case by the justice as against two of three defendants can be maintained as •against the two defendants as to whom the case was dismissed.
