The appellant brought this action in the District Court to set aside an award of the Industrial Accident Board of the State of Texas in'.favor of the legal beneficiaries of John Konvicka, deceased, an employee of the A. O. Smith Corporation, based on his accidental injury and death in Harris County, Texas, on November 18, 1948. The defendants, beneficiaries, filed a cross action.
