In this appeal, the plaintiff, Ronald Coulombe, seeks to reverse a decision of the Superior Court {Wyman, J.) upholding the labor commissioner’s denial of a claim for disability benefits. Because we agree that the plaintiff’s claim is barred by RSA 281:40, we affirm.

On May 25, 1971, Ronald Coulombe, an employee of Noyes Tire' Company, suffered traumatically induced epilepsy as a result of a work related accident.
