Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Based upon an allegation that petitioner sent a sexually explicit letter to a nurse at the correctional facility where he was incarcerated, he was charged in a misbehavior report with engaging in harassment, making threats, committing a sexual offense and violating facility correspondence procedures.
