The above-named defendants have been charged with a violation of section 21-3 of article 21 of the Code of Ordinances of the City of Rome, New York, which reads as follows: "Sec. 21-3. Disorderly Conduct. It shall be unlawful for any person to make, aid, countenance or assist in making any disturbance, or improper diversion, or to behave in a disorderly manner in the streets, in any public or private premises, or elsewhere in the City, to the annoyance or disturbance of citizens or travelers.
