On March 8,1950, a jury in the Police Court of the City of Troy found the defendant guilty of violating subdivision 5-a of section 70 of the Vehicle and Traffic Law. After the imposition of a sentence of thirty days in the Rensselaer County Jail the defendant was admitted to bail pending appeal.

The pertinent provisions of subdivision 5-a recite: ‘ ‘ Any person operating a motor vehicle * * * who, knowing that injury has been caused to a person, due to the culpability of the person operating such motor vehicle * * * or to accident, leaves the place of said injury or accident, without stopping…
