Today, we decide, among other things, whether a driver who led. officers, on a freeway chase and jumped out of a moving car is entitled to a jury instruction on the lesser included offense of evading arrest or detention on foot as opposed to the greater offense of doing so in a vehicle. 1 In four issues, appellant Jacob Brent Smith challenges (1) the sufficiency of the evidence in support of his conviction for felony evading arrest or detention in a vehicle, (2) the trial court’s refusal to submit jury instructions on two lessér included offenses, and (8)…
