McGHEE, Justice.

The appellant was convicted of the crime of manslaughter and sentenced to a term of years in the state penitentiary, from which verdict and sentence 'this appeal is brought.

On the afternoon of June 2, 1951, the defendant went to the home of the deceased, Guadalupe Alvarez, and upon his arrival found the deceased was not at home. In a short time he left the home of the deceased and went to a neighboring house where he drank beer and wine. When it began to grow dark he again went to the home of the deceased, who had then returned. There was testimony he called the deceased out…
