Robert Odenwelder, a widower with three children, aged forty-two years, wed Sabina Messinger, a widow with two children, September 22, 1877. The conjugal relation thus established continued for more than seventeen years, when, upon December 3, 1894, it was terminated by the death of the husband. Prior to the date of his death, two of the children of the first marriage had died, leaving Mary Richards, the wife of Elijah J. Richards, the appellant in this ease, as the only surviving child.
