J ones and others, as citizens and taxpayers of Toombs County, filed their information in the nature of a quo warranto, to inquire into the right of Darby td'hold the office of commissioner of roads and revenues of Toombs County. Darby was elected as such commissioner on November 4, 1930. The board of county commissioners of said county was created by the act of August 29, 1929. Ga. Laws 1929, p. 725.
