HISTORY OF THE CASE

On April 28, 1969, plaintiff, a California resident, delivered certain copyrighted photographs to defendant Chace Company Advertising, Inc., a California corporation. Those photographs were to be used for advertising purposes in connection with a “tourist emergency program” sponsored by the Santa Barbara Chamber of Commerce and various oil companies following the oil spill disaster of 1969.
