LANIER, Judge.
ON REMAND
This is a suit for damages in tort arising out of an automobile accident which resulted in a fatality. The parents of the deceased driver claim damages for wrongful death. After a trial on the merits, the jury found the defendant driver was not negligent. In accordance with the jury’s finding, the trial court rendered judgment in favor of the defendants, dismissing plaintiffs’ demands. Plaintiffs took a devolu-tive appeal to this court.
