MONTEITH, Chief Justice.

This action was brought by E. C. Alexander in regular form of trespass to try title to recover from a number of defendants a tract of land located in Bazoria County, Texas, alleged to be a vacancy and subject to lease as unsurveyed school land. The State of Texas, acting through its attorney general, intervened in the suit, alleging that the location of the boundaries of the tract of land sought to be recovered had been fully determined and adjudicated by this court under the doctrine of stare decisis in the case of State of Texas v.
