Pyramid Technology Corp. v. Cook (In Re Cook)
United States Bankruptcy Court, E.D. Pennsylvania
1Opinion of the Court
OPINION
DAVID A. SCHOLL, Bankruptcy Judge.
A. INTRODUCTION
The instant proceeding is another prime exhibit in making the case that proceedings attacking a debtor’s discharge under 11 U.S.C. §§ 727(a)(3) or (particularly, in this case) 727(a)(5) — which require no showing of a debtor’s intent in acting or failing to act — are far more readily sustainable than not only proceedings attacking a discharge under 11 U.S.C. §§ 727(a)(2) or 727(a)(4), but also proceedings attacking only the dis-chargeability of a specific debt under 11 U.S.C. § 523(a).
