•— Appeal by defendant from a judgment of the Supreme Court, Kings County (Starkey, J.), rendered September 15, 1981, convicting him of criminal possession of a weapon in the third degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law and as a matter of discretion in the interest of justice, and new trial ordered. Defendant was indicted for criminal possession of stolen property in the first degree and criminal possession of a weapon in the third degree. At the trial, police officers testified that in December, 1980 defendant was driving a car with two occupants.…
