MEMORANDUM AND ORDER

SIFTON, District Judge.

Plaintiff brings this action under sections 1 and 2 of the Sherman Act, 15 U.S.C. §§ 1 and 2; sections 4 and 26 of the Clayton Act, 15 U.S.C. §§ 15 and 27; the Donnelly Act, New York General Business Law § 340; and the common law of restraint of trade. This Court has jurisdiction over plaintiff’s claim pursuant to 28 U.S.C. §§ 1331 and 1332 and 15 U.S.C. §§ 15 and 27. The gravamen of plaintiff’s complaint is that the defendant Multiple Listing Service of Long Island, Inc. (“MLSLI”) will not permit him to join that organization unless he becomes a…
