Appeal by the defendant from a judgment of the Supreme Court, Queens County (Clabby, J.), rendered May 3, 1993, convicting him of criminal possession of stolen property in the fourth degree and unauthorized use of a vehicle in the second degree, after a non-jury trial, and imposing sentence.

Ordered that the judgment is modified, on the law, by reducing the defendant’s conviction of unauthorized use of a vehicle in the second degree to unauthorized use of a vehicle in the third degree, and vacating the sentence imposed thereon; as so modified, the judgment is affirmed.
