This is an action by a passenger to recover from the defendant, an interurban carrier, damages caused by. a knife wound inflicted on plaintiff by another passenger. The jury found that the defendant’s conductor, in the exercise of ordinary care, ought to have known from the conduct of the assaulting passenger that a physical injury to one of defendant’s passengers was threatened, and should have attempted to prevent such injury. ■ This want of ordinary care on the part of the conductor was the proximate cause of the injuries complained of, and there was no contributory negligence.
