This is an appeal on questions of law from a judgment of the Common Pleas Court of Putnam county, Ohio, dismissing an appeal on questions of law and fact from the court of W. H. McClung, a justice of the peace of Van Burén township, Putnam county, Ohio.

The motion on which the judgment of dismissal by the Common Pleas Court was entered sets forth three grounds for the dismissal of the appeal from the justice’s court, as follows:
