James Franklin Limbaugh, Jr., was indicted for the offense of murder, in violation of § 13A-6-2, Code of Alabama 1975. The jury found him guilty as charged in the indictment, and he was sentenced to life imprisonment. On appeal, this Court reversed the conviction and remanded the case for further proceedings.Limbaugh v. State, 549 So.2d 582 (Ala.Cr.App. 1989). On remand, Limbaugh was arraigned again and he entered a plea of not guilty. A jury was struck, and at the conclusion of the trial the jury found Limbaugh guilty as charged in the indictment, and he was sentenced to life imprisonment.…
