— Appeal from a judgment of the Supreme Court at Special Term (Cholakis, J.), entered February 4, 1982 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the Commissioner of the State Department of Agriculture and Markets. Petitioner, National Farmers Organization, Inc., is a foreign corporation licensed to sell milk in New York State. Since 1976 it sold milk to A. Lasaponara & Sons, Inc.
