Appeal by the defendant, Julia Mary Snell, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, •and o£ the defendants other than herself, entered in the office of the clerk of the county of Kings on the 8tli day of May, 1897, upon the decision of the court rendered after -a trial at the Kings County Special Term.

Cullen, J.:

This action was brought to partition certain real estate of which one Thomas W. Townsend died seized. Townsend died intestate, and the several parties to the action claim as his heirs at law. Concededly, the parties are all children of Townsend, but the appellant, Julia Mary Snell, claims that the children other than herself are illegitimate and not entitled to inherit. This is the only controversy in the case.

It appears by the evidence that Townsend, a resident of Great Britain, was married to Sarah Ann Stickalorum, at London, on September 21, 1863. They lived together until…
