Dent, Judge:

Jerome B. Akin appeals from a decree of the circuit court of *457Monongalia County against him in favor of Charles A. Weaver and others.

The history of the ease is as follows: On the 18th day of September, 1897, Charles Powell obtained from A. P. Hanght the following lease: “In consideration of the sum of one dollar, the receipt of which is hereby acknowledged, A. P. Etaught, of ‘Batalle’ district, ‘Mongahale’ Coiinty, West Virginia, first party, hereby grant unto Charles Powers, second party, his heirs and assigns, all the oil and gas in and under the following described premises,…
