—Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Clinton County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

Petitioner, a prison inmate, was charged with fighting and assaulting another inmate. Following a disciplinary hearing, he was found guilty of both charges and a penalty of 270 days in the special housing unit with loss of packages, commissary and telephone privileges and three months’ loss of good time was imposed.
