In the circuit court of Lauderdale couiity appellant was convicted of assault with intent to kill and murder, and sentenced to the penitentiary for ten years.

The indictment charged that the assault with intent to kill and murder was upon one “A. C. Parnell and Ernest Danner, by then and there discharging a deadly weapon, to-wit, a pistol, at and toward the said A. C.
