NIX, Judge.
Bobby Allan Thacker, plaintiff in error, was tried before jury in the District Court of Stephens County, Oklahoma, on the charge of arson. He was found guilty and sentenced to a term of three years in the state penitentiary from which judgment and conviction he has appealed to this court. The evidence reflected by the transcript of the proceedings shows that defendant was convicted for burning the home of H. P.
