OPINION

JONES, Judge.

The defendant, Floyd McAfee, was convicted of grand larceny and found to be an habitual criminal by a jury of his peers. After his motion for a new trial was denied by the trial court the defendant appealed as of right to this Court pursuant to Rule 3(b), Tenn.R.App.P.

In this Court the defendant contends the evidence is insufficient to support his conviction for grand larceny as well as a finding that he is an habitual criminal, and the trial court committed error in refusing to clarify its instructions when the jury requested a clarification during the habitual criminal…
