JOHNSON, J.' —

The respondents are the heirs of Matthew Sparks who died testate in Adair county March 7, 1906. The appellant was the brother of the deceased and on April 20, 1907, became administrator of the estate under letters of administration with will annexed issued by the probate court of Adair county. It appears that in the interim between the death of *653the testator and the issuance of the letters appellant administered the personal estate.
